摘要
研究专利客体审查标准的执行一致问题,从实质审查的操作瓶颈以及典型案例的审查方式剖析等方面讨论专利客体审查标准执行不一致产生的原因,并对客体审查方式提出改进建议。
This paper concerns with the issues of the implementation of consistent for the examination criterion of the subject matters of patents. The reasons which bring the variance of the examination criterion implementation for the subject matters of patents are discussed based on the analysis of handling bottle-neck in the substantive examination and the examination methods in the typical examples. Some suggestions to improve the examination modes are proposed.
