摘要
"基本权利不可克减"是紧急状态法制的重要法律原则。根据这一原则,即使在危及国家生存的紧急状态,一些基本权利也无论如何不能被克减。不可克减原则对国家克减公民权利设立了清晰的界限,直接体现了紧急状态法制的基本价值,有助于维护个人利益和公共利益间的平衡和少数人权利的保护。在我国紧急状态法制中确立不可克减原则是宪法人权保护原则的必要体现,是完善我国紧急状态法制,促进应急管理法治化的需要,也是政府未来履行国际义务的需要。为此,我国宪法应对克减权和不可克减的权利做出明确的规定。
That some fundamental rights are non-derogable is a very important legal principle in the legal system of states of emergency. Under this principle, even in states of emergency which might impose threat to the survival of the state can some fundamental rights not be derogated. The principle of non-derogation sets clear limit to the exercise of derogation power, directly embodies the fundamental value of the legal system of states of emergency and is conducive to maintain the balance between public interests and personal interests and the protection of rights of the minority. Therefore, identifying this principle by the legal system of states of emergency will necessarily manifest the principle of respect and protect human rights" spelt out in Chinese Constitution on the one hand, and it will meet the requirement of the perfection of the legal system of states of emergency and the practice of crisis management, as well as the performance of international obligation by Chinese government on the other. For these reasons, the Constitution shall make clear provisions on the derogation and non-derogable rights.
