摘要
劳动者休息权是一种宪法权利,我国劳动法对用人单位延长工作时间的限制性规定就是为了保障劳动者休息权的实现。由于我国有关延长工作时间的规定执行不力,导致用人单位违法延长工作时间成为常态,这不仅危害了劳动者的休息权,还给我国经济社会发展造成了不利后果。我们必须依据现有国情,通过立法,完善相关制度,限制用人单位延长工作时间的行为,以确保宪法对劳动者休息权规定的实现。
Laborer's right to rest is a constitutional right. Our labor law aims to realize laborers' right to rest via the restrictive regulation on employers' prolonging employees' working time. Since the execution of such regula tion is so weak that the phenomenon becomes normal, which destroys laborer's right to rest and causes our economy and social to develop adversely. We must better the relevant system through legislation on the base of our national conditions to limit the employers' behavior to prolong employees' working time and guarantee the realization of labo- rer's constitutional right to rest.
