我国不动产登记机关审查标准的法理反思

摘要 不动产登记机关在不动产登记中处于控制地位,首要职责是对当事人的申请进行审查,作出决定。采用何种登记审查标准,对登记的公信力、登记的效率和准确性以及登记错误的责任承担都有重要的影响,理论上的认识不一,实践中的作法也各异,不仅对不动产权利人的权利保护极为不利,而且也将极大地损害登记机关的严肃性和权威性,所以明确审查标准对不动产登记制度至关重要。 The real estate registration is in a position of control in the registration. Its first duty is to review the applieation of a party and make a decision. The standard of review for registration, registration credibility, efficiency and accuracy of the registration and registration error responsibility has the important influence. Moreover, there is not a theoretical understanding, and methods in practice are also different. So these are very adverse for human rights in the real estate rights to protect, but also greatly for the seriousness and authority of the registration. So explicit reviewing standards of the real estate registration system are crucial.
