摘要
近年来,在一系列国内政策的扶持之下,我国的新能源产品开发产业取得了迅猛的发展。这一发展势头引起了美国相关行业和有关部门的关注,一系列政策措施也因被认为违反我国加入世界贸易组织应承担的义务而受到强烈指责。选取美国贸易代表处针对中国政府有关新能源政策发起的"301"调查中认为我国相关政策违反了取消禁止性补贴的世贸组织义务这一部分,展开事实分析与法律分析,对我国政府有关政策的合规性进行评价,并提出建议。
China＇ s new energy product industry is relatively under developed. It has only developed quickly with the domestic policy support in recent years. The development has also drawn the notice from American indus-try and official units and these measures have been considered to be violating Chinese WTO obligations and has been criticized harshly. This article selects part of the 301 investigation concerning Chinese new energy policy, which has held that China＇ s policy has violated the obligation of abolishing the prohibitive subsides, and has carried out the factual and legal analysis. The author tries to find out its compliance with WTO roles and offers suggestlons.
