摘要
化学品污染是气候变化的重要原因,而我国应对气候变化的立法尚为空白,化学品污染防治立法在应对气候变化方面也供给不足。化学品污染防治立法对气候变化兼具减缓性和适应性,需要在生态整体主义理念指导下,对化学品进行全面、系统的综合性立法,确立保障生态安全、人体健康的立法目的。我国化学品污染防治立法需着重强调预防原则与全面管理原则;完善化学品计划与规划制度,调整化学品产业结构,发展绿色化学;统一化学品毒性鉴定管理,以"最佳适用技术"为原则严格化学品环境标准制度;完善化学品登记制度,建立化学品信息系统数据库;完善化学品环境影响评价制度,增加对气候变化的影响评价。
Chemical pollution is an important reason for climate change.However,China neither has any climate change legislation nor adequate chemical pollution prevention legislation coping with climate change.Therefore,it is urgent to improve our chemicals pollution prevention law to find an effective solution to the climate challenge.Under the idea of ecological holism and the purpose of ensuring health and security,only comprehensive and systematic chemical pollution prevention legislation can alleviate climate change.This article suggests that Chinese legislation on chemical pollution is supposed to emphasize the principles of prevention and comprehensive management.It is also urgent to adjust the Chinese industrial structure and improve the management system of chemicals.Moreover,it is important to unify chemicals toxicity appraisal management,improve chemicals registration system and build chemicals information system and database.Last but not the least,it is demanded to add impact assessment about climate change to our chemicals environmental impact assessment system.
