摘要
民事检察调查权是指检察机关为依法履行国家法律监督职能,在提请或提出民事抗诉前收集有关作为抗诉依据的事实材料的权力,我国现行法律对其没有明确规定。文章从赋予检察机关民事检察调查权的必要性角度出发,对民事检察调查权的概念、特征、行使原则以及具体制度设计作了初步探讨,以期对民事检察工作有所助益。
The civil prosecutorial en- forcement power refers to the power that in order to fulfill the function of legal supervision of state in accordance with the law. Procuratorial organs are given the power of collecting Factual material as protest basis before proposing a civil protest. There is no clear regulation in the current law. This paper discusses the concept, characteristics, principles of civil prosecutorial enforcement power, and concrete system design in view of the necessity of civil prosecutorial enforcement power, so as to help the civil prosecutorial work.
