摘要
作为世界范围内诉讼立法中普遍存在的制度,亲属证人拒证权有着重要的意义。运用法经济学的研究方法,对司法机关和亲属证人不同主体的作证成本和收益进行分析,更加明晰设立亲属拒证特权的价值性,为我国建立完善的亲属拒证权提供相应的理论依据。
As one of prevalent litigation institution in the world, family privilege has important significance for a democratic nation. By means of law economics, we conduct a study of the costs and benefits concerning the testifying by judicial organs and family members to reinforce the value of the establishment of family privilege. It is hoped that the paper will offer a theoretical basis for establishing and perfecting the law system of family privilege in our country.
