摘要
网络通讯监听作为IT时代一种重要的技术侦查手段,既有众多的正面价值,亦存在不少负面价值,凸显着价值悖论。前者包括有效满足打击现代犯罪的需要、合乎现代民主社会公民权利运作的要求两方面;后者包括容易损害公民人权、易导致侦查权的滥用和诱发司法伦理困惑三方面。只有在充分认识其价值冲突基础上积极加以法制化引导,才能真正确保其兴利除弊。
As an important technical detection method in IT era, it is proved through analysis that internet communication monito- ring has its merits and demerits, which demonstrate value paradoxes. The merits include two aspects： effectively attacking the modern crimes and greatly encouraging the civil rights operation in modern democratic society, while the demerits include easy impairment of civil rights, possible abuse of investigation right and easy induction of judicial ethical bewilderment. Only if the value paradoxes of in- ternet communication monitoring are profoundly studied under the legal guidance, can the technique be well used to realize its positive functions.
