摘要
借用市场分析法阐释市场经济条件下法治行为的进程 ,提出依法治国必须提高立法质量、优化法律组合 ;必须适当减少法治行为的外部性 ,降低守法成本 ,提高守法收益 ,同时提高违法成本 ,提高执法效率 ,形成较高的作案风险预期 。
The article explains the process of “Ruled by law”with the market analysis. To run the country by law requires to improve the quality of logislation and legal construction, to reduce the cost of law maintenance, and at the same time to increase the cost of breaking the law and the effect of enforcing the law and all of these can produce a higher risk of committing crime and reduce the profit of breaking the law to the lowest.
