摘要
死刑不引渡是国际司法协助中一个非常重要的原则,死刑不引渡原则在引渡制度有着非常重要的作用。在我国随着区际刑事司法协助的发展,这一原则受到了挑战。在区际刑事司法协助中应该做相应的变通执行,即移交逃犯。并应该结合我国的具体国情具体实施。
nonextradition for death penalty is an important rule in international judicial assistance. In our country,this rule is facing a challenge,and therefore the regional judicial assistance needs some flexible execution,i.e.to deliver escaped prisoners.
