摘要
欧盟排放交易机制的立法进程对中国碳交易立法具有借鉴意义。中国可以借鉴欧盟渐进式的立法进路,并结合自身特点,通过试点模式,摸索建立大范围的温室气体排放交易机制的可行性。欧盟排放交易机制立法全面的智力支持体系对中国的启示是:应对温室气体排放交易机制进行系统化的研究,综合分析应对气候变化的各种政策并保证各利益方的充分参与。
The European Union emission trading scheme has made remarkable achievements since its establishment in 2005.In order to build a low carbon economy,China is exploring the quotas system for emi-ssions and trying to develop the emission trade market.The legislation process of European Union emission trading scheme is of great significance to China＇s legislation of carbon trading market.China can learn from EU＇s legislative approach and explore the feasibility of establishing a wide range of greenhouse gas emissions trading mechanism through pilot projects in light of its own characteristics.EU＇s comprehensive intelligence support system suggests that we should study greenhouse gas emissions trading mechanism systematically,undertake a comprehensive analysis of various policies addressing climate change and ensure that all stakeholders have opportunities to voice their views.
