摘要
建筑物区分所有权之成员权,是成员权人基于建筑物的物理构造、使用功能和权利归属的不可分性形成的共同关系而彼此所享有的权利和承担的义务。只有加强对成员权的法律保护,才能进一步维护区分所有权人的合法权益,更好地体现广大业主的意愿。文章在分析成员权的概念、内容,行使原则与管理方式的基础上,提出了成员权在行使过程中所遇到的侵权问题及应采取何种方式救济,以期实现对区分所有权人的法律保护。
The member rights of ownership of building differentiation,who are members of the building right based on physical structure,function and the right to form the inseparable relationship together of each other's rights and obligations.Only strengthen the legal protection of member right,then maintenance distinguish the legitimate rights and interests of the owners of the broad owner better reflect desire.Based on the analysis of the concept,nature of member right exercise,the content,the principles and management methods,the paper put forward the problems and the relief way and realizes in distinguishing the legal protection.
