摘要
对于保险代位权在再保险中的适用问题,存在着肯定与否定的两种见解。基于对再保险的性质认定、体系和文义解释,及与替代机制的对比,再加之对再保险具体类型中保险代位权之适用可能的分别考察可知,再保险人应当具有保险代位权。再保险人行使保险代位权的基本模式是"摊回说"之模式,但是尚存在特定情形下约定排除"摊回说"的例外。
There are affirmative and negative views on the issue of applying insurer＇s subrogation right in reinsurance. This paper expounded on the nature of reinsurance and its literal construction and systematic interpretation in insurance law. Meanwhile, it compared reinsurance with substitute mechanisms and analyzed the possibilities for the subrogation rule being applied to specific types of reinsurance. In view of the above-mentioned reasons, this research affirmed that the reinsurer should have subrogation right. The paper held that reinsurers could exercise the subrogation right with the ＂claim refunding model＂. However, there was also the case of excluding ＂claim refunding＂ through endorsement set between the reinsurer and insurer.
