摘要
在计划经济向市场经济转型的过程中,水库移民的利益诉求与权利主张都对以公权为基础构建的传统安置模式提出了新要求,政府应在承认水库移民正当利益与合法权利的基础上,通过法律制度完善与管理体制改革,切实保障移民利益,并协调出现的各类利益冲突,从而促进和谐移民局面的形成。
In the transition from a planned economy to a market economy,the interest demand and claim of reservoir resettlement puts forward the new requests for traditional resettlement mode based on public right.This paper offers that on the basis of admitting the legitimate rights and interests of reservoir resettlement,through perfecting the legal system and reforming management system,the government should ensure immigration interests,harmonize all kinds of conflict of interest,so as to promote the formation of harmonious immigration situation.
