摘要
电子证据时间鉴定是判断电子证据所记录时间信息是否受到篡改的一种专门性活动。当前学术界和实务界对其科学性颇有疑问。信息转移原理和信息系统理论认为,篡改电子证据的时间必然会引发信息转移现象,必然会破坏其时间体系的内在关联。
Time determination of electronic evidence is a special act which authenticates the information of electronic eVidence from the altered time original time information. Nowadays, there are doubts both in the academic and practical fields about whether the time determination is scientific. From the information transfer theory and information system theory, the authors expound the scientific foundation of the time determination of electronic evidence. They point out that unauthorized modification of the time of electronic evidence can trigger information transfer and destroy the inherent relevance of its time system.
