摘要
本文拟从"文学与法律比较研究"的视角论述英国文学史上著名作家托马斯·哈代的悲剧小说《苔丝》中的法律问题。哈代对法律的关注以及浓厚兴趣,使得我们从法律视野进行审视成为可能。从财产继承法、婚姻法、刑法等三个方面探究苔丝悲剧命运的法律渊源,能为我们阐释哈代悲剧作品及其悲剧人物提供一个新的视角,从而让我们感受到,这部以主人公死亡作为结局的悲剧小说不仅是性格的悲剧、命运的悲剧,还是法律的悲剧。
The author of this article tries to use the way of ＂comparative study of literature and law＂ to probe into some legal matters in the tragic novel Tess of the d’Urbervilles by Thomas Hardy. A legal examination of the novel is possible because of Hardy’s strong interest in and focus on the law. Using the new perspective to study this novel, the present author tries to explore the legal sources of Tess’ tragic fate by analyzing the laws described in the novel, especially the laws related to marriage, property inheritance system and criminal justice system. It can be concluded that Hardy’s tragic novels, with the protagonists’ deaths as the endings, not only reflect the tragedy of characters or of fate, but also the tragedy of the law.
