摘要
虚拟财产是计算机网络发展下的新生产物,其现实的社会价值一直存在争议,从虚拟财产自身的特性和价值的认定上来确定虚拟财产的实际价值,以适用传统财产罪的犯罪对象的认定。对侵犯虚拟财产入罪进行合理性论证,有利于更好地应对网络环境下虚拟财产对传统财产罪对象理论的挑战。
The virtual property is an innovated term along with the development of the network,and the real social values are highly controversial on this.This article researches on its characteristics and values to determine the existing value so as to apply to traditional property crimes.For the infringement of the virtual property crime rationality analysis,it is necessary to well explain the constitutive requirement of traditional property crimes so as to deal with the challenge of virtual property.
