摘要
日本法科大学院中开设环境法课程的虽然比较多,但是分配的学分(2~4学分)和时间比较少。本来,在帮助学生理解环境问题的同时教授环境法是理想的做法,但是,由于教师和学生双方的原因,这一点并没有完全实现。在本科教育中,虽然不开设环境法课程的大学比较多,但也有的大学将环境法作为本科法学教育的重要一环来定位。
This report discusses the status quo and issues of the environmental law course in undergraduate, postgraduate educa- tion and law schools in Japan, including its syllabuses. The courses are set in most law schools, and is mainly offered by schol- ars of administrative law or civil law, because environmental law is an elective subject of the bar examination. Many students take environmental law as an application subject of civil law and administrative law. Its tendency is not desirable for environ mental law teaching but it gives students an opportunity to understand the importance of the environmental law. In contrast, there are not many undergraduate and graduate schools with this course set, because the teaching staff commonly consider envi- ronmental law as an optional subject. Even if they think environmental law is important, it would also be difficult to recruit new staff. One of the most imt)ortant issues is how to train and increase environmental law scholars.
