摘要
以97刑法修订为分水岭,经过十多年的发展,中国刑法学已经发生了深刻的转变:刑法学研究重心发生根本转变,即刑法学的研究重心从面向刑法立法、服务刑法立法向面向刑法司法、服务刑法司法转变,刑法学理论与司法实践关系发生重大转变;刑法学对待刑法典态度的根本转变,即刑法学由批判刑法典向捍卫刑法典转变,刑法学的意识形态色彩隐退,规范色彩凸显。转变之所以深刻,是因为这一转变意味着刑法学转型大体已经完成,规范刑法学已基本确立。
Taking the Criminal Law Amendment 97 as a watershed,after ten year＇s development,China＇s criminal law has undergone profound changes： the focus of the Criminal Law Research had a fundamental change too： the focus of criminal law is from facing criminal legislation and serving criminal legislation to facing criminal justice and serving criminal justice;changes in the relationship of criminal law theory and judicial practice and a fundamental change in the attitude towards the Penal Code.This means that the transformation of criminal law has generally been completed and the basic norms Of criminal has been established.
