摘要
随着近年人们传统婚姻观念的转变,因解除同居关系而产生的析产纠纷案件数量增多。审判机关在处理该类案件时,面临着同居关系种类繁杂、同居期间财产权利流转法律规范缺失、法律适用标准不明确等诸多问题,从而导致执法尺度的不统一。梳理同居关系析产案件所包含的同居类型,结合现有相关立法,明确法律适用基本原则,从法理的角度厘清同居关系析产纠纷的相关法律问题。
With the changes of people＇s viewpoints of marriage, there are many cases of properties division disputes in cohabitation. Because of the various kinds of cohabitation relationship, lack of related lawmaking and identical standard lawsuit, judicial organs don＇t behave accurately in the law enforcement. In order to solve these problems, the paper analyzed the different types of cohabitation and defined the lawsuit principles under the current law and legislation.
