摘要
"人肉搜索"这一搜索方式存在侵犯个人信息权和隐私权之虞。个人信息包含隐私的内容,是隐私的上位概念。除隐私以外的能够把主体直接或间接识别出来的信息均属于个人信息的范畴。侵犯隐私权的构成要件之一是存在公布他人隐私的行为,而侵犯个人信息权的构成要件之一是对个人信息的商业利用。通过"人肉搜索"披露他人的隐私,即构成侵犯隐私权。在此基础上,如果对获取的个人信息加以商业利用,则侵犯他人的个人信息权;如果滥用获取的个人信息则侵犯他人的其他合法权益。
In There are possibilities to violate the right of personal information and privacy right by using the internet mass hunting. Personal information contains privacy, being its upper concept. Besides the privacy, the information which could distinguish a person directly or indirectly belongs to the personal information. The critical one to violate the privacy right is to publish others＂ privacy. By means of internet mass hunting, other people＇s privacy are released, which can be called violation of privacy right legally. On the basis of this, if the information is used to make money, then the personal information is committed. If personal information is abused, then other people＇s legal rights are violated.
