摘要
在急功近利思想与粗放型发展模式的惯性影响下,政府主导区域发展存在非理性冲动。为贯彻中央政府科学发展战略转向,更好地应对区域发展的资源、环境、土地、劳动力等要素约束日益趋紧,区域发展应回归理性。而从法律维度考察,法律应为这一"回归"提供制度保障,即地方政府在维护区域发展利益、争夺区域发展机会、实现区域发展权利的同时亦必须为其不当行为所带来的问题承担责任,甚至要负法律上的责任。弘扬"人要为发展负责"的法治精神即是对这一现实需求的法理念回应。
Under the inertia influence of the thought of seeking quick success and instant benefits as well as extensive development patterns,an irrational impulse exists in the government-oriented regional development.Regional development should return to rationality in order to implement the strategic shift of scientific development of the central government and better respond to the increasingly serious constraint of several factors for regional development,such as resources,environment,land and labor.Studying from the legal point of view,the law should provide institutional guarantee for the ＂return＂,i.e.the local government must be responsible for the problems caused by their improper actions and even should bear the legal liability while maintaining the interest of regional development,competing for the opportunity to develop and achieving the regional rights for development.Promotion of the legal idea that ＂People should be responsible for the development＂ is the response of the legal idea to the actual demand.
