摘要
国际投资法应对气候变化的深层合法性理由主要包括三个方面,一是风险预防原则的需要,二是部门法律与社会问题之间关系所决定的国际投资法作为部门法跨域调整气候变化问题的内在需求,三是使国际投资法应对气候变化得以实现的前提——国际合作,具有现实可能性。这些理由使国际投资法应对气候变化问题成为必须和可能。
International investment law should aim,to some extent,at resolving the climate change issue.The justifiability of international investment law’s countering climate change is in three aspects:the need of precautionary principle,the internal need of international investment law decided by the relationship between sectoral laws and social issues,and the practical possibility of international cooperation which is primary to the point.
