摘要
基于通过立法促进关天经济区科技资源统筹的目的,需要明确统筹科技资源的内容、范围和方式,分析我国统筹科技资源立法现状,关天经济区科技资源的特点、统筹所要解决的难点问题及其成因,进而提出通过中央和地方的区域性立法,建立内容配套、体系合理的关天经济区统筹科技资源的法律法规制度。中央立法层面,应当明确统筹科技资源的公益性,统筹科技资源的主体、权限、对象、程序,科学技术研究计划的审批、评估制度,制定针对体制问题的单行法。地方性立法,应当解决当地特有问题,力戒地方保护主义,规范与科技发展相关规划、计划的制定和实施,关注企业对共享科技资源的需求。
The construction of a model base for coordinating science and technology resources in Guanzhong-Tianshni Economic Zone has encountered conspicuous problems like the barriers between the central government and the local government, between military use and civ- il use, and problems like the structural imbalance in science and technology resources. Such problems should be tackled through legislation on both national and local levels. On the national level, the legislation should clarify the following: the public interest nature of the coordi- nation of science and technology resources, the subject, limits of authority, object, procedure, approval and evaluation of science and technology research projects. Slip laws should be formulated to handle structural issues. Legislation on the local level should try to deal with unique local issues, abstain from local protectionism, standardize the formulation and implementation of related plans and projects, and pay close attention to the needs for the sharing of science and technology resources on the part of enterprises.
