摘要
由于自由心证制度是在对其他证据制度进行辩证否定的基础上发展起来的,故多数学者认为自由心证制度应当成为我国将要制定的统一证据法的基本内容。裁判者自由心证的范围首先应包括证明力的判断,这是自由心证制度的题中应有之义,其次,由我国诉讼追求的价值目标以及一元式的审判组织结构决定,自由心证的范围还应及于证据能力的判断。当然,自由心证的范围问题还包括补强证据规则的定位与补强证据的判断等问题。
