摘要
P2P等网络技术的运用,一方面使音乐作品的传播变得更为方便、快捷,另一方面也给音乐作品的版权保护带来了前所未有的冲击和挑战。面对越来越多的网络侵权现象,基于我国现有立法与实践中的不足,应当构建一个以法律保护为主,与技术措施及集体管理制度相结合的全面、有效、合理的音乐作品版权保护体系。
P2P network technology,on the one hand,has made the spread of the music work become more convenient and efficient;on the other hand,it is giving unprecedented impact and challenges to the music copyright protection.To solve the increasing cases of network infringement,based on the current lack of legislation and practice,it is proposed to establish a comprehensive,effective and reasonable music copyright protection system,which is composed of legal protection,technical measures and collective management system.
