摘要
行刑个别化是当下中国监狱十分关心的一项改造技术,但这对项技术无论是理论研究,还是实践探索,都还有许多值得注意的问题,弄清它的含义,辩析其模式与经验、把握其根据和价值所在、探求其实践路径,能够促进我们更加理性地看待当下中国监狱的行刑个别化实践活动。
Individualization of penalty is a reform technique about which the present Chinese prisons are mainly concerned.However,either in theoretical study or in practical exploration,there exist some problems that merit further investigation.A rational examination of individualization of penalty in the present Chinese prisons requires understanding clearly its connotation,identifying its mode and experience,grasping its base and value and exploring its practical path.
