摘要
以法律来保护公民的合法财产，保护私营企业的健康发展无疑是必要的。我国现有刑法尚无具体条文规定雇员侵犯私有业主财产行为的刑法处罚，国外用侵占罪、背信罪、盗用罪来保护私有企业的合法财产权的做法是值得我们借鉴的。
It is of undoubted necessity to provide legal protection of citizens' property rithts and maintain the healthy development of private enterprises.However,the criminal law of our country does not carry any concrete provisions about the penalty of the emplyee who viloates the property of the be in the private enterprise.There os much that we can use in the method adopted by foreign countries.They haw weed out the crime of encroachment,that of perfidy and that of embezzlement to protect the legitimate property right of private enterprises.
