摘要
美国式的辩诉交易是在美国当事人主义诉讼架构下的自然产物 ;美国发达的律师制度是辩诉交易有效适用的保障 ;泛化的契约文化观念为辩诉交易提供了合法性的文化基础 ;社会普遍接纳的实用主义哲学是辩诉交易产生并成长的思想基础 ;案件的压力和司法资源的有限性是辩诉交易盛行的直接原因。 2 0 0 2年 ,我国黑龙江省牡丹江铁路运输法院适用“辩诉交易”审结了一起故意伤害案后 ,引起了广泛的讨论 ,有人主张现在就应该引进构建中国式的辨诉交易。虽然我国目前不具备引入辩诉交易的法律制度基础与文化观念基础 ,由于我国也面临案件激增的压力 ,从长远看 ,有引入此项制度的必要。现在 ,我们要做的工作是目前我国应为借鉴辩诉交易制度积极创造运行的条件、配套措施 ,改进和完善相关的制度环境 ,待条件初步具备时 。
The plea bargaining of American style is the natural product in the partyism of the U.S.;the highly developed attorney system guarrantees the effective availability of plea bargaining;the pan concept of covenant lays the cultural foundation for the legality of plea bargaining;the generally accepted philosophy of pragmatism has prepared the ideological base for the birth and growth of plea bargaining;the pressure of cases and the limitation of jurisdiction is the immediate cause of the prevalence of plea bargaining.The court of Mudanjiang railway transportation,Heilongjiang province,China,put an end to the trial of an intentional injury case by plea bargaining in 2002,which has triggered an extensive debate.It has been argued that the plea bargaining of Chinese style should be introduced.At present,there is an obvious lack of the foundation of legal system and the base of culture for the introduction of plea bargaining.In the long run,however,due to the pressure of increasing cases,the introduction of the system of plea bargaining is indispensable.What should be done in China now is to actively create the operating conditions and improve related systematic environment for the introduction of plea bargaining.When the conditions basically prepared,this system will be considered to introduce in legislation.
