摘要
行业协会作为同业经营者所组成的维护同业经营者共同利益的社会组织,其在维护竞争的过程中可以发挥积极的作用。同时为了成员的整体利益,行业协会也很有可能通过决议来限制竞争。并且其表现形式多种多样,既有直接的手段,也有间接和隐蔽的方法。因此,将行业协会纳入竞争法的规制范围,是十分重要和必要的。
Guild,which is organized by operators of the same business and is on the behalf of the operators at the same time,has played a positive role in maintaining fair competition.However,it probably passes a solution to restrict competition for the members' interests.The methods could be various,from direct ways to indirect means.Therefore,it is necessary and important to regulate guild's activities by competition law.
