摘要
根据我国现行《民事诉讼法》规定的基本原则的体例十分混乱的状况,试图在分析《民事诉讼法》的功能及特征的基础上,提出新的识别标准,进而依此剔除现行《民事诉讼法》中不适格的基本原则并引入其中未有的有益原则,从而重构我国《民事诉讼法》的基本原则,只有这样才能使《民事诉讼法》的基本原则更加符合当前的社会情势,发挥其应有的功效。
Under the chaotic conditions of the style of current civil procedure law＇s basic principles, the new identification standards are proposed based on the analysis of the functions and characteristics of civil procedure law, to exclude the inappropriate basic principles of current civil procedure law and introduce useful principles to reconstruct the basic principles of China＇ s Civil Procedure Law. That is the only way to make the basic principles of civil law consistent with the current social situation, and play its due effect.
