美国知识产权滥用的反垄断法规制的趋势分析 被引量：2

摘要 知识产权制度和反垄断法之间存在潜在冲突,这是在知识产权领域引发反垄断问题的根源。从近年来美国反垄断当局立场看,近年来产生重大转变,其在知识产权领域的反垄断政策呈现宽松趋势,这其中既有经济学基础也有法律制度基础。这些值得我国执法机构制定政策时借鉴参考,但更应注重结合我国企业在国际竞争中的实际情况,而不必盲从。
