摘要
我国建设用地市场城乡分割的现状在很大程度上阻碍了城乡统筹发展的进程。构建城乡统一的建设用地市场是建立和完善社会主义市场经济体制,扭转集体建设用地流转状态,促进耕地保护和土地集约利用,确立国有与集体土地所有权主体平等地位,实现城乡统筹发展的需要。建议按照严格界定经营性和公益性用地、平等开放和同等待遇、切实保护农民的根本利益、完善集体土地所有权的原则,加快集体建设用地市场建设,完善土地征收和征用市场,设立城乡统一的流转方式,实行地、价、权的进一步统一,构建城乡统一的建设用地市场。
Urban-rural intersected status in construction land market in China largely hampered the coordinated development process.Constructing urban-rural unified construction land market is the need to establish and perfect socialist market economy system,to reverse collective construction land circulation state,and to promote the protection of cultivated land and intensive utilization of land.And it is also necessary for establishing equal status between state-owned and collective land ownership and achieving urban-rural coordinated development.Several countermeasures were put forward,for example,speed up the construction of collective construction land market,improve land expropriation and requisition market,establish urban and rural unified transfer way,implement further unification of land,price,right and consolidate urban and rural construction land market according to the principle of strictly defining business and public lands,equality open and equal treatment,protecting farmers' basic interest,and improving collective land ownership.
