摘要
对于"礼不下庶人,刑不上大夫"的争议主要是因为"礼"、"刑"、"庶人"、"大夫"等概念理解的差异。本文认为,"礼"既然作为行为准则,自然要求上至贵族,下至庶人都要学礼守礼。所谓"礼不下庶人",只是那些在贵族内部举行、用来巩固贵族组织的"礼"不允许庶人参加而已。"刑不上大夫"仅指宫刑不及于大夫。
The disputes on ＂The ceremony less than common people,punishment is not to the doctor.＂ are mainly because of the ＂li＂,＂punishment＂,＂common people＂,＂doctor＂ and different understanding of the concept.This paper argues that ＂li＂ since,as the code of conduct to the requirements of natural nobility;down to the common people have Miller Shurei.The so-called ＂gift less than common people＂,only those held within the nobility,the nobility used to consolidate the organization＇s ritual does not allow common people to participate in it.＂Punishment is not to the doctor,＂ refers only to castration is less than in the doctor.
