摘要
非物质文化遗产是少数民族重要的文化权利之一,但长期以来并未引起国家和各级地方政府的重视,在具体的知识产权法律保护方面则更显欠缺。厘清少数民族非物质文化遗产的定义和特征,阐述对其进行知识产权保护的重要性,分析我国少数民族非物质文化遗产知识产权保护不力的现状及其原因,并在此基础上,有针对性地提出加强我国少数民族非物质文化遗产知识产权保护的4点建议。
The intangible cultural heritage is one of the important minority cultural rights.Yet it is not placed great emphasis by nation and local governments.And it is deficient in the aspect of the special intellectual properties＇ legal protection.In the paper the author clarified the definition and features of the minority intangible cultural heritage,explained the importance of its intellectual property protection,analyzed the present situation and reasons of its deficient protection in China,and then put forward four proposals to strengthen its protection.
