摘要
我国以社区矫正和管制刑为代表,在行刑社区化过程中存在一些问题,应当在制度立法、评估机制以及监督机制等方面加以完善。作为一项系统工程,还应包括对刑罚文化观念、人员素质、配套设施和经费等方面进一步完善。
The socialization of execution punishment is the achievement from the innovative ideas and concept of criminal penalties theories in modem society. The community - based execution punishment is an important manifestation of it. Community - based Execution of Punishment is both a community - based execution, and the types of community - based penalties. It requires a certain ideological and theoretical foundation, and mature practice conditions. There are some problems in the community - based execution of punishment, such as community corrections and public surveillance. It should be improved in legislation, evaluation mechanisms and monitoring mechanisms. As a systems engineering, it should also include the penal concept, quality of personnel, facilities and funding, etc. to be further improved.
