摘要
对合同自由进行限制已成为学界的共识,但是应该清楚认识到,对合同自由的限制只能是手段而不能是目的。如果忽视市场在资源配置中的优势作用和交易双方的自由意志而对其随意限制,则必然导致极为严重的后果。限制太大就会挫伤交易双方的积极性从而影响经济的发展,政府等主体如果随意对合同自由加以限制,缺乏必要的监督,则必然会产生滥用权力与腐败。在对合同自由进行限制时,有必要做到正当限制与谨慎限制。正当限制即政府等主体在限制合同自由时要依照法定的程序进行;谨慎限制即要求对合同自由的限制要把握好"度",畸轻畸重都将影响经济的稳定发展。
To restrict freedom of contract has become the consensus of scholars, but it should be well aware, that, the restrictions on freedom of contract can oniy be a means and not an end. If you ignore the market in resource allocation in the role and advantages of the free will of the parties to the transaction of its arbitrary limit, will inevitably lead to very serious consequences. Too restrictive will dampen the enthusiasm of parties to the transaction to affect economic development, government and other body if the arbitrary restrictions on freedom of contract, tack of necessary supervision, the abuse of power and corruption will inevitably produce. Restrictions on freedom of contract, it is necessary to achieve the legitimate limitations and prudent limits. The government and other restrictions that limit freedom of contract should follow the statutory procedures ; careful restrictions that limit freedom of contract requirements also should grasp the ＂degree＂, being too unbalanced will affect the economic stability and development.
