摘要
目的对药监执法过程中住宅检查权的正确运用提出建议。方法介绍了住宅检查权的定义、性质及法律依据,分析了住宅检查权与非法侵宅、非法搜查的区别,探讨了在药监执法过程中住宅检查权的正确运用问题。结果与结论在特殊原因、特定条件下,药监部门可行使住宅检查权,依法定程序、运用法定手段、检查法定区域,及时发现、处理涉药违法行为,维护良好的市场秩序。
Objective It provided recommendations for properly using the residential inspection right in drug enforcement.Methods Introduce the definition,nature and legal basis of the residential inspection right.Analyze distinction of the residential inspection right,the illegal invasion and illegal search.Discuss the problems of proper use for the residential inspection right in drug enforcement.Results and Conclusion Under special reasons and specific conditions,pharmaceutical inspection authorities may exercise the residential inspection right,according to legal procedures and legal means to check the legal area,in order to the timely find and deal with irregularity drug and maintain a good market order.
