摘要
通过分析工程款优先受偿权与商品房预售制度、在建工程抵押制度、预告登记制度、行使优先受偿权的期限、行使优先受偿权的专业、支付工程款的合理期限、劳务分包人权利七个方面存在的法律冲突,指出了这七个法律冲突是如何阻碍工程款优先受偿权行使的,同时也提出了解决相应障碍的思路。指出只有解决了这些法律上的冲突,才能真正发挥工程款优先受偿权保护承包人利益不受侵犯的作用。
By analyzing the conflicts of laws between the right priority to the debt for projects and real estate sale system,mortgage system in progress,notice registration,duration of the exercise of priority claim,priority claim to exercise professional,a reasonable time period to pay for projects,the rights of labor subcontracting,the paper points out that how the seven conflicts of law obstruct the project and put several solutions to solve the problems.Then the article points out that only by addressing these conflicts of law can we really make the right to really protect the interests of the contractor away from infringement.
