摘要
在21世纪的今天,法官造法已经成为一个古老而常新的名词,特别是在我国这样一个受理性主义以及中国传统法律思想影响的社会主义国家中,实行法官造法任重而道远。随着社会的发展,法官造法在中国司法实践中已深入人心,本文通过分析法官造法的概念特征、理论来源和中国法官造法的现状,以求解决实践中种种疑难案件,为中国未来的法官造法制度开辟道路。
In the 21st century,judge-made law has become one of the old and constant new nouns,especially in our country-a popular rationalism and Chinese traditional legal thoughts influencing socialist country.Implementing the judge-made law is not easy.With the development of society,judge-made law in the judicial practice has already made us cause popular feeling in China.In order to practice for China＇s future judge-made law system path,through analyzing judge-made law concept,characteristics,theoretical sources,China＇s current judge-made law status,we are able to tackle various complicated cases.
