摘要
公共行政人员的道德规束是基于理想、价值、责任、德性、内省等个人精神追求与自我完善基础上的自我控制或道德自觉。道德规束是确保制度正义实现的德性基础,是构建权力运行制约与监督机制的核心要素,它在与制度约束、社会文化环境约束的交相辉映中共同实现对权力运行主体的持续作用、协同作用和整体作用,从而使权力运行制约与监督机制的构建真正不落制度建设或道德建设的单向度而徒劳无功的窠臼。
Moral restriction on public administrative personnel refers to the self control or self-consciousness of moral on the basis of individual's personal pursuit and self-improvement such as ideal,value,responsibility,personality,and introspection.Moral restriction is the moral basis for achieving justice and the kernel element for constructing mechanism of power operation and supervision.It functions sustainably,coordinately and organically with system restriction and socio-cultural environment restriction,so that the construction of power operation and supervision mechanism will not fall behind the system construction and moral construction.
