摘要
医疗纠纷是因医务人员的医疗行为造成患者损害或提供的医疗服务没有达到其预期的要求而产生的医患矛盾。市场经济条件下,对于医疗纠纷需要从医方、患方、社会和法律法规等多方面进行防范。其中医方在医疗纠纷的解决中处于主导地位;患者应当了解医疗行为的高风险性,积极配合治疗;社会有关部门应密切配合,有效地化解和减少医疗纠纷的发生;在法律、法规方面采取相应的措施是有效解决医疗纠纷的关键。
The medical disputes bring about the doctor- patient contradiction because the medical treat- ments cause damages to the patients and the medical service fails to satisfy the patients' anticipation. The medical disputes should be prevented in the aspects of hospitals, patients, society, laws and regulations in the market economy. Among these aspects, hospitals should play a dominant role in dealing with medical disputes; patients should understand the high risk of the medical treatment and actively cooperate with the medical treatment; the relevant social departments should coordinate closely and effectively solve and reduce the medical disputes; and the corresponding laws and regulations function as a key to settling the medical disputes effectively. Only by multiple countermeasures, can the medical disputes be resolved effectively so as to con- struct the harmonious doctor patient relationship.
