摘要
现代法治提出了对司法判决的确定性和正确性的双重要求,"确定性"和"正确性"这两个对立的概念统一于哈贝马斯所提出的"有效性"概念中,内化为"事实有效性"和"规范有效性"两个维度。平衡艺术是"事实有效性"和"规范有效性"两个维度的平衡,"事实有效性"具有优先性,"规范有效性"具有统摄性。说理艺术强化了法律的正当性,体现了公民和法律的一致性,培育公民遵守法律的自觉性,没有说理就没有现代法治意义上的司法判决。
The certainty and correctness are the dual requests that modern law has to the judicial judgment.These two contrary concepts are integrated with Habermas＇ concept of validity and converted into two dimensions：facto validity and normative validity.The art of equilibrium is the balance of the two dimensions.Facto validity has the priority while normative validity has the governance.The art of argument strengthens the legitimacy of the law,embodies the coherence between citizens and the law and fosters citizens＇ consciousness to obey the law.Without the argument,there is no judicial judgment in the perspective of modern law.
