摘要
当前兼具灵活性和人性化特征的非强制性行政行为在环境执法中应运而生。平衡论为环境执法中采用非强制性行政行为提供法学理论依据。环境非强制性行政行为与环境执法的结合正是基于环保理念和环境非强制性行政行为的互融性、共通性的必然趋向。环境执法中采用环境非强制性行政行为适应环境问题综合性和环境违法案件的多元化的需要,引导利益主体实现动态平衡,调动全民共同解决环境问题的积极主动性,有利于降低环境执法成本,提高执法效率,减少环境行政管理权滥用的可能性和危害。
Non-compulsory administrative action characterized by humanization and flexibility has been applied in the enforcement of environmental protection,and the balance theory provides the basis for the application of the action.The combination of administrative activity without compulsion and enforcement of environmental protection is based on the interweaving and common point of environmental protection idea and administrative activity without compulsion.The application of non-compulsory administrative action the in enforcement of environmental protection meets the requirements of comprehensive environmental problems and diversified illegal environmental cases,which arouses the enthusiasm of the whole people to solve environmental problems,reduces the cost of the enforcement of environmental protection and improves the efficiency of the enforcement,and reduces the probability of abusing executive power in the enforcement.
