摘要
滥用市场支配地位指享有市场支配地位的企业出于排斥竞争或者控制市场的目的,依赖自己的市场优势地位对相关市场的其他竞争者或者交易对手进行不公平交易的行为。滥用市场支配地位行为的认定应当从形成市场支配地位与滥用市场支配地位两个方面进行。腾讯公司强制性要求软件用户在360产品和QQ之间进行选择,其行为本身是一种限定用户交易行为的法律性质,即违反了我国《反垄断法》的相关规定而构成滥用市场支配地位。对滥用市场支配地位的行为进行规制需要从完善现行立法与加强行业自律等两大方面同时进行。
Misusing the market dominant position behavior is defined that the company which has the market dominant position commits unfair transactions with its competitor or its client to exclude competition or to control the market.Establishing the identity of the misusing the market dominant position behavior depends on its status and relative misuse behaviors.The Tencent forced customers to choose one software product between Odd Tiger 360 and Tencent,which restricts its customer's consuming behavior.That's to say,it violates the relative articles of antitrust law and actually forms the misusing the market dominant position behavior.To regulate the misusing behaviors,the laws and the industry self-discipline should be improved simultaneously.
