摘要
由于忽视对立法目的的探讨和提炼,对如何理解"审判的时候怀孕的妇女"存在聚讼。以"限制死刑主体,废止孕妇死刑"为目的,可以对此作出和谐统一的、合目的的解释。"审判时"包括整个刑事诉讼程序与死刑判决执行程序。"孕妇"应指怀孕的所有情形,包括正在怀孕、曾经怀孕和异常怀孕等。刑法第49条与相关司法解释、刑诉法第211条等的规定不存在矛盾。
Because of negligence over researches about its legislative purpose and a lack of abstraction of such purpose,consequently,we have seen long lasting disputes over the understanding of the term ＂a woman who is pregnant at trial＂.However,it is possible to give a unified and teleologically correct interpretation of this term,by viewing its purpose as ＂limitation of death penalty and repeal of death penalty on pregnant woman＂.With this in mind,＂at trial＂ shall cover the complete legal process,including the criminal trial proceeding,and the execution of death penalty,regardless of such matters as whether or not the woman is in custody or under any other coercive measures.The term ＂Pregnant woman＂ refers to the woman under any case of pregnancy ＂at the trail＂,which includes the woman who is being pregnant,who has been pregnant and who is under abnormal pregnant conditions such as ectopic pregnancy,molar pregnancy,etc.Penal Code Article 49 have no contradiction with the related judicial interpretations and the Code of Criminal Procedure Article 211 and so on.
