摘要
指出了我国就业歧视主要表现为性别歧视、户籍歧视、年龄歧视和其他方面的歧视。剖析了在新制度经济学的框架中,就业歧视行为实质就是在市场竞争中达不到资源最优配置的帕累托最优状态的情况下,有限理性经济人通过一种惯常的价值判断和认识体系,从而实现对劳动力生产要素配置的一种次优选择。提出了我国可以借鉴国外的反就业歧视的经验,通过制定《反就业歧视法》等措施构建我国反就业歧视法律制度和组织机构,以保障全体社会成员平等就业的权利。
Now the major patterns of employment discrimination are concerned with gender,registered permanent domicile,age and other aspects and so on in China.Based on the theory of neo-institutional economics,the essence of the behavior employment discrimination is inferior optimality choice of labor production made by limit rationality man on condition that resource allocation out of Pureto optimality.We can make Anti-Employment Discrimination law on the related legal practice in the United States,which can ensure equality in employment.
