摘要
当执法风险在监狱语境中日益严峻化,并成为公众关注和监狱审查的主题时,可以说它们就从默默无闻的小角落中走了出来,在监狱和学术辩论中获得了核心的重要性。执法风险对于现代化监狱和民警的不可抗拒的威胁以及带来的"新窘困"迫使我们不得不冒险涉足其间,渗入监狱表象世界,孜孜以求地进行测绘、考察、诊断,以发掘、治理、认识、避免或转移监狱执法风险给我们带来的不安全感和焦虑。承认"监狱的稳定与和谐体现在各种矛盾的动态平衡中,而非一种被‘冻结’的静止状态"这一命题,择善而从,顾此而不失彼,希冀能开创性地为监狱学界和实务界提供更多冷静观察和理性思考,为监狱执法风险的防范和化解激发更多的推动力和聚合力。
When the law-executing risk in the prison is becoming more and more serious,and being the subject that the public are focusing on and the prison is checking,they came out from the unknown corner,and gained the importance of center in the discussion of prison and academy.The irresistible threat to modern prison and police from the law-executing risk and new embarrassment made us have to set foot in it,penetrate the seeming world of prison,diligently map,inspect,diagnose,in order to discover,manage,know,avoid and transform the insecurity and anxiety that occurred by the law-executing risk in the prison.Admitting the proposition： the stability and harmony of the prison reflect in the dynamic balance of different contradictions,and its not a still situation of freezing,we should choose and follow what is right,attend to one thing and another,and hope to initiatively provide more cool observations and rational thoughts to prison and practice,and stimulate more impetus and cohesion for the prevention and settlement of the law-executing risk in the prison.
