摘要
我国网络管理法制化建设应当实现四个转变:在立法理念上,从秩序维持向权利保障转变;在管理理念上,从消极防范、积极管制型向强化沟通、积极合作型转变;在管理手段上,从事前审批管制向事中(后)监管制转变;在管理机制上,从政府主导型管理向社会参与型管理转变。
Legal construction of Chinese network management should change from four aspects. For the legislative ideas, it should change from order maintain mode to rights protection mode. For the management ideas, it should change from negative precaution and active control to positive communication and cooperation. For the management means, it should change from former pre-approval to supervision later. For the management mechanism, it should change from the dominance of government to the community participation.
